Welcome to our website https://www.oldwolf.ch and to our electronic applications (hereinafter: the platforms). The following general conditions apply to all products sold on the platforms by Oldwolf Aude, a company having its registered office at Avenue des Alpes 25, 1820 Montreux, Switzerland (hereinafter: Oldwolf).


By subscribing to our services on the platforms, and placing an order, you agree to be bound without reservation by these general conditions of subscription (hereinafter: general conditions).

Oldwolf reserves the right to modify the general conditions. The version of the general conditions in force at the time of the conclusion of the subscription contract and/or the order applies. If parts of the general terms and conditions are for one reason or another unenforceable or invalid, the validity of the remaining provisions shall not be affected.

In the event of inaccuracies and/or contradictions between the German, French and/or English versions of these conditions of sale, only the French version is authentic.

Please read these terms carefully before using our platforms.

1.Concept

Oldwolf offers an innovative and flexible subscription formula allowing customers to have meals cooked by a chef delivered to their home or workplace. By subscribing to Oldwolf's services, the customer has access to several ranges of standardized or personalized meals, made from a variety of products and, if possible, seasonal, depending on the nutritional approach pursued by the customer.

2. Conclusion of the subscription contract and order

2.1 Subscription contract

To order, the customer must be subscribed to the services offered by Oldwolf on its platforms.

The subscription is reserved for people with the capacity to perform legal acts.

Signing up for a subscription is free. When concluding the subscription contract, the customer personalizes the meal program according to his preferences: he defines the food variant, the number of meals he wishes to receive per week and the food exclusions (thanks to the contact form, by e-mail or telephone). The customer fills in his personal data and payment information before confirming payment for the first order. Upon confirmation of payment for the first order, the customer is subscribed. He thus receives between one (1) and two (2) times a week and with his agreement a box containing the meals prepared in accordance with the personalized program determined by the client. Payment for subsequent orders may be automatically debited seven (7) days prior to the corresponding delivery if Oldwolf deems it necessary.

The personal data required for customer registration must be complete and truthful. The customer undertakes to keep his data up to date.

Promotional offers, information, order confirmations sent by Oldwolf to customers are addressed to the e-mail address indicated by the customer at the time of the conclusion of the subscription contract.

2.2 Order

Before placing an order, the customer must verify and correct the information and contact details
seizures. The customer is not entitled to any reimbursement for products ordered by mistake and/or sent to the wrong address. By confirming his first order, the customer places a firm order for products offered by Oldwolf, automatically renewed each month. Unless modified, suspended or terminated, the order is automatically validated seven (7) days at 11 p.m. CET before the next delivery date.

Oldwolf confirms to the customer the receipt of his order by e-mail immediately after confirmation of payment.

3. Modification, suspension and termination of the subscription

The subscription may be modified, suspended or terminated at any time without notice and without charge by the customer, by e-mail or telephone. The subscription may also be suspended or terminated at any time by Oldwolf, without justification, notice or compensation for the customer. Modifications, suspensions and terminations do not apply to
validated orders, with the exception of changes relating to the delivery address which can be made up to two working days before delivery. Some modifications in the choice of meal programs are
likely to cause a price change.

4. Services of Oldwolf

4.1 Preparation of products

Oldwolf prepares and markets cooked meals made from fresh, natural ingredients and containing no
no additives. The recipes developed by Oldwolf mainly favor local and seasonal products. The cooking methods used are chosen with respect for health and the environment. The images of the products presented on the site do not come under a contractual obligation. These are presentation suggestions. Under no circumstances can Oldwolf be held responsible for any discrepancy between these images and the actual appearance of the products.

4.2 Deliveries

The dishes ordered by the customer are packaged in individual trays and delivered to the place agreed by the
customer, in an airtight box which guarantees optimal packaging.

Oldwolf takes care of the delivery of the boxes itself, once the customer's agreement has been obtained concerning the place and
delivery time.

Oldwolf declines all responsibility in the event of theft or damage in the event of the customer's absence during the delivery of the
package what the customer explicitly recognizes by accepting the general conditions.

4.3 Perishable products

Oldwolf draws the customer's attention to the perishable nature of its ready meals.

The customer must place the cooked meals in a refrigerator at 2-4˚C no later than 11 p.m. (Swiss time) on the day of delivery, the sooner the better, and keep them there. If the customer has to move his dishes before consumption, he must ensure that the cold chain is respected. The expiry date is shown on
the label of each dish, and the customer must comply with it.

If these instructions are not followed, serious problems may arise, and Oldwolf cannot be held responsible.

4.4 Complaints

Oldwolf makes every effort to deliver all products ordered in sufficient quantities and in impeccable quality. In some cases, however, it may happen that, for various reasons, a product is no longer available in the required quantities or that it cannot be delivered within the requested time. If a product is not
available at the time of delivery, Oldwolf is authorized to replace it at constant price with another similar product, of the same kind and if possible of
better quality, in the subscription formula chosen by the customer. In the event of replaced products, the customer cannot claim either compensation or damages. If an invoiced product cannot be delivered, the corresponding amount is refunded to the customer. There is no new delivery and the customer cannot claim damages. If, for reasons beyond the control of Oldwolf (for example: delivery address
incorrect, absence of the addressee, access prohibited, circulation made difficult by bad weather or road traffic), delivery is made impossible or almost impossible, Oldwolf is entitled to cancel the order. Any claim by the customer to any compensation in kind or in damages is in this case entirely excluded.

Oldwolf will take into account complaints relating to cooked meals and will try to respond to them as best as possible. However, due to the perishable nature of our products, any request concerning them must be made to us within a maximum of forty-eight (48) hours after their delivery, by the means of contact listed below.

5. Price and Payment

5.1 Price

All prices indicated on the platforms are in Swiss francs, including applicable VAT. The prices applied are those displayed on the platforms at the time of the order. Oldwolf may change its prices at any time without notice.

5.2 Payment

Oldwolf debits the amount of each order placed on its website at the time of validation. The payment occurrences of orders made outside the Oldwolf website can be defined in agreement with the customer.

5.3 Stripe secure payment platform

Payment for orders is possible by means of a Visa or Mastercard credit card or the Twint solution via the Stripe secure payment platform (we invite you to read Stripe's General Terms and Conditions of Use).

Before the first order, the customer indicates his payment information and expressly agrees that these
information is kept by the Stripe platform for the exclusive purpose of being used for the payment of orders made under the subscription contract.

The Stripe platform collects information related to the method of payment (payment card number or bank account information, for example), the amount of the purchase, the date of purchase and the method of payment. The information collected may vary depending on the payment method used.

As part of its fraud monitoring, prevention and detection activities, Stripe may also receive personal data about you from our business partners, financial service providers, identity verification services and sources accessible at public (by
example, name, address, telephone number, country of residence), in order to confirm the identity of the customer and to prevent fraud.

6. Intellectual Property

Oldwolf has an exclusive right of ownership and use of the brands, product descriptions, images, logo,
photos and texts of the platforms. All these rights are reserved. It is strictly forbidden to copy, reproduce, republish, download, send, distribute, transmit, communicate to the public or use any content of
our platforms in any way without the express permission of Oldwolf.

7. Protection of personal data

We invite you to refer to our data protection declaration which can be consulted on our website.

8. Applicable law and jurisdiction

Swiss law applies to the legal relationship between Oldwolf and the customer. The legal venue for natural persons is Montreux or the customer's place of residence. The exclusive legal forum for legal persons is Montreux.
